Community Council Recommendations

The Etobicoke York Community Council recommends that:

 

1. City Council amend the Official Plan for the lands at 1233 to 1255 The Queensway substantially in accordance with the draft Official Plan Amendment attached as Attachment 4 to the report (June 12, 2026) from the Director, Community Planning, Etobicoke York District.

 

2. City Council authorize the City Solicitor to make such stylistic and technical changes to the draft Official Plan Amendment as may be required.

Summary

This report recommends approval of the application to amend the Official Plan to redesignate the subject lands from Mixed Use Areas to Mixed Use Areas and Parks to accommodate two new parks. It also proposes the addition of two new streets (A and B), and a new Site and Area Specific Policy to provide a policy framework that supports a mixed-use development at 1233 to 1255 The Queensway. This would include amendments to Map 15 (Land Use Plan), Schedule 2 (The Designation of Planned but Unbuilt Roads) and Chapter 7 (Site and Area Specific Policies). Key elements of the proposal are summarized below.

 

- A total of six development blocks containing a variety of land uses including residential and non-residential.

- A childcare facility to be secured as an in-kind benefit during the Zoning By-law amendment process.

- Two new public parks with minimum areas of 7,566.2 square metres for Park A and 1,013.6 square metres for Park B, to be secured during the Draft Plan of Subdivision process. The parks would be complemented by additional public realm elements including pedestrian mid-block connections.

- Two new complete streets that include cycling infrastructure and 2.1 metre wide pedestrian clearways, with Street A connecting the site to The Queensway and Zorra Street, and Street B connecting the site with The Queensway and Street A.

- The proposal is to be developed in five phases and would allow for the continuous operation of portions of the existing mall for as long as possible during construction.

- A Housing Issues Report is to be submitted with a Zoning By-law Amendment application to address affordable housing.

 

Approval of this Official Plan Amendment application does not constitute or imply approval of the heights, density, and other project statistics contained in the architectural plans submitted to the City. A Zoning By-law Amendment application and a Draft Plan of Subdivision application are required to be submitted and approved by the City prior to any development proceeding on any part of the site. Proposed heights, density and other project statistics will be reviewed through the Zoning By-law Amendment application. A Community Consultation Meeting will also be held.

 

The proposed Official Plan Amendment is consistent with the Provincial Planning Statement (2024) and conforms to the City's Official Plan. It advances the Official Plan's objective of creating complete communities by proposing a policy framework that supports complete communities and represents good planning.

Community Council Recommendations

The Etobicoke York Community Council recommends that:

2. b. Make a corresponding decrease to the quantity of required short and long-term bicycle parking, to reflect the changes required to accommodate the increased non-residential gross floor area.

Summary

This report provides final recommendations as a result of the completion of the Lake Shore Boulevard West Study. The study was conducted in a three Phase process over the past two and a half years and has included extensive consultation with city staff, community members, residents, the local Councillor, landowners, businesses, local Business Improvement Areas (BIAs), Humber College, industry professionals, and other stakeholders.

 

Throughout the study period, changes were made to the applicable planning framework, particularly, Provincial policies and City-wide Official Plan policies, zoning by-laws, and guidelines. The proposed recommendations align with the City-wide Council-adopted policy framework for Avenues and include feedback received through the consultation process of the Study. This has resulted in recommendations that provide a tailored built form and public realm vision along the Lake Shore Boulevard West Avenue through the proposed Official Plan and Zoning By-law Amendments and the Lake Shore Boulevard West Urban Design and Streetscape Guidelines.

 

This report recommends that City Council adopt the following Official Plan and Zoning By-law amendments as well as the Lake Shore Boulevard West Urban Design and Streetscape Guidelines, which provide guidance for future development in the area.

 

The proposed Official Plan Amendment (951) includes:  

- Re-designation of certain lands abutting the existing Mixed Use Areas lots fronting the Avenue within the Study Area from Neighbourhoods to Mixed Use Areas;

- Deletion of the existing Site and Area Specific Policies (SASP) 21 and 822;

-  Amendments to SASP 23 to add a policy for a Precinct Plan to be provided with the existing requirement for a Block Context Plan (contained in Schedule 3 of the Official Plan) for new development on the lands; and

- Amendments Map 7A and existing policy C9 to establish new Identified Views from the from Lake Shore Boulevard West to Lake Ontario.

 

The Zoning By-law amendment would apply to lands designated Mixed Use Areas to provide development permissions for mid-rise buildings. The Urban Design and Streetscape Guidelines will illustrate urban design principles and best practices to guide new development, public works and local change as the area grows and evolves over time.

 

The recommended Official Plan and Zoning By-law Amendments are consistent with the Provincial Planning Statement (2024) (the "PPS 2024") and conforms to the City's Official Plan.

Community Council Recommendations

The Etobicoke York Community Council recommends that:

 

1. Summary

This report advises that the Executive Director, Development Review intends to approve the Draft Plan of Subdivision to divide 1025 The Queensway into eight development blocks (Blocks 1 to 8), two park blocks (Blocks 10 and 11), three new public streets (Public Streets A, B, and C), two enhanced landscape areas (Blocks 9 and 14), two privately owned publicly-accessible spaces (POPS) (Blocks 13 and 15), and a new private driveway (Block 12).

 

City Council approved the related Zoning By-law Amendment application to permit a mixed-use development at 1025 The Queensway at its meeting of June 25 and 26, 2025, however, the associated draft Zoning By-law (Bill) was not enacted. Prior to introducing the Bill for enactment, Council requires that the applicant obtain Draft Plan of Subdivision approval for the whole site from the Executive Director, Development Review, and enter into an In-Kind Contribution Agreement pursuant to Section 37(7.1) of the Planning act to secure the proposed Childcare facility.

 

The proposed Draft Plan of Subdivision meets the subdivision requirements in Section 51(24) of the Planning Act, is consistent with the Provincial Planning Statement (2024), and conforms with the City’s Official Plan.

Community Council Recommendations

The Etobicoke York Community Council recommends that:

 

1. City Council amend the Official Plan for the lands municipally known as 5 and 43 Junction Road substantially in accordance with the draft Official Plan Amendment included as Attachment 5 to the report (June 18, 2026) from the Director, Community Planning, Etobicoke York District.

 

2. City Council amend City of Toronto Zoning By-law 569-2013 for the lands municipally known as 5 and 43 Junction substantially in accordance with the draft Zoning By-law Amendment included as revised Attachment 6 to the report (June 18, 2026) from the Director, Community Planning, Etobicoke York District.

 

3. City Council authorize the City Solicitor to make such stylistic and technical changes to the draft Official Plan Amendment and draft Zoning By-law Amendments as may be required.

 

4. City Council approve that, in accordance with Section 42 of the Planning Act, prior to the issuance of the first above grade building permit for Phase 2 (Block 3), as shown in the Phasing Plan included as Attachment 7 to the report (June 18, 2026) from the Director, Community Planning, Etobicoke York District, the owner shall convey to the City, an on-site parkland dedication (Block 4), having a minimum size of 2,306 square metres, to the satisfaction of the Executive Director, Development Review and the City Solicitor.

 

5. City Council approve the acceptance of on-site parkland dedication, subject to the owner transferring the parkland to the City free and clear, above and below grade, of all easements, encumbrances, and encroachments, in an acceptable environmental condition. The owner may propose the exception of encumbrances of tiebacks, where such an encumbrance is deemed acceptable by the Executive Director, Development Review, in consultation with the City Solicitor; and such an encumbrance will be subject to the payment of compensation to the City, in an amount determined by the Executive Director, Development Review and the Executive Director, Corporate Real Estate Management.

 

6. City Council approve a development charge credit against the Parks and Recreation component of the Development Charges for the design and construction by the owner of the Above Base Park Improvements to the satisfaction of the General Manager, Parks and Recreation. The development charge credit shall be in an amount that is the lesser of the cost to the owner of designing and constructing the Above Base Park Improvements, as approved by the General Manager, Parks and Recreation, and the Parks and Recreation component of development charges payable for the development in accordance with the City's Development Charges By-law, as may be amended from time to time.

 

7. Prior to the issuance of the first above grade building permit, including any conditional above-grade building permits for the first phase of the development, City Council require the owner to post financial security in the amount of the value of the parkland dedication owed for the entire development, as appraised by the Executive Director, Corporate and Real Estate Management, and such security shall not be released until the parkland (Block 4) is conveyed to the City in a manner satisfactory to the Executive Director, Development Review; the financial security shall be paid in a form satisfactory to the City, and from the date the financial security is first paid to the City to such time as the parkland is conveyed to the City, be indexed upwardly in accordance with the appropriate Statistics Canada index for the Toronto Census Metropolitan Area to the satisfaction of the Executive Director, Development Review. 

 

8. Prior to the issuance of the first above grade building permit, including any conditional above-grade building permits for the first phase of the development, City Council require the owner to register in priority a Section 118 Restriction, pursuant to the Land Titles Act against title to the future parkland (Block 4) to be conveyed to the City, that prohibits the transfer or charge of the parkland without the prior written consent of the Executive Director, Development Review, to the satisfaction of the City Solicitor.

 

9. City Council accept the owner's offer of an in-kind contribution (attached as attachment 14 to this report) pursuant to subsection 37(6) of the Planning Act and allow the owner to provide a minimum of five percent of the residential gross floor area of each phase in the development for which the owner intends to apply for a Plan of Condominium, as affordable rental housing for a minimum of 40 years to the satisfaction of the Executive Director, Development Review, and the Chief Planner and Executive Director, City Planning and the Executive Director, Housing Secretariat (the “In-kind Contribution”) all in accordance with the following terms:

 

a. the unit mix of the Affordable Rental Housing Units shall reflect the unit mix of the market units within each phase of the proposed development;

 

b. the average unit size of the Affordable Rental Housing Units shall be no less than the average unit size of all the market units, by unit type, in each phase of the proposed development;

 

c. the minimum unit size of the Affordable Rental Housing Units shall be no less than the minimum unit sizes of all market units, by unit type, in each phase of the proposed development;

 

d. the Affordable Rental Housing Units shall be provided in contiguous groups of at least six rental dwelling units;

 

e. the general configuration, location and layout of the Affordable Rental Housing Units in the development shall be to the satisfaction of the Chief Planner and Executive Director, City Planning;

 

f. tenants of the Affordable Rental Housing Units shall be provided with access to, and use of all indoor and outdoor amenities in the development at no extra charge; access to, and use of, these amenities shall be on the same terms and conditions as any other resident of the building without the need to pre-book or pay a fee, unless specifically required as a customary practice for private bookings;

 

g. all Affordable Rental Housing Units will be provided with ensuite laundry facilities and central air conditioning at no extra charge;

 

h. tenants of the Affordable Rental Housing Units will be provided with access to permanent and visitor bicycle parking/bicycle lockers in accordance with the Zoning By-law and on the same basis as other units within the development.

 

i. the initial rent (inclusive of utilities) charged to the first tenants of and upon turnover of the Affordable Rental Housing Units shall not exceed Affordable Rents as currently defined in the Official Plan for a minimum of 40 years, beginning with the date each such unit is first occupied (the "Affordability Period"). During the Affordability Period, increases to initial rents charged to tenants occupying any of the Affordable Rental Housing Units shall be in accordance with the Residential Tenancies Act and shall not exceed the Provincial rent guideline, regardless of whether the Provincial rent guideline applies to the Affordable Rental Housing Units under the Residential Tenancies Act;

 

j. the owner shall provide and maintain the Affordable Rental Housing Units as rental dwelling units at the rents identified in 9.i above for the duration of the Affordability Period. The Affordable Rental Housing Units shall not be registered as a condominium or any other form of ownership, such as life lease or co-ownership, which provide a right to exclusive possession of a dwelling unit, and no application for conversion for non-rental housing purposes, or application to demolish any Affordable Rental Housing Unit shall be made for the duration of the Affordability Period; upon the expiration of the Affordability Period, the owner shall continue to provide and maintain the Affordable Rental Housing Units as rental dwelling units, unless and until such time as the owner has applied for and obtained all approvals necessary to do otherwise;

 

k. the owner will use the City's Centralized Affordable Housing Access System to advertise and select tenants for the Affordable Rental Housing Units, provided it is in place, unless otherwise agreed to by the Executive Director, Housing Secretariat; and at least six months in advance of any Affordable Rental Housing Unit being made available for rent, the owner shall develop and implement an Access Plan which will outline how the Affordable Rental Housing Units will be rented to eligible households in consultation with, and to the satisfaction of, the Executive Director, Housing Secretariat;

 

l. the Affordable Rental Housing Units shall be made ready and available for occupancy no later than the date by which seventy percent of the new dwelling units erected in the condominium building within each phase of development as are available and ready for occupancy; and

 

m. the Owner shall enter into one or more appropriate agreements with the City to the satisfaction of the City Solicitor and the Chief Planner and Executive Director, City Planning, to secure the rental tenure of any buildings in the development for which a Plan of Condominium application will not be made and which will not be required to  provide affordable housing in accordance with the proposed Official Plan Amendment and for which the Owner will pay the CBC for the portion of the lands that is purpose-built rental.

 

10. City Council attribute a value to the In-kind Contribution, equal to 100 percent of four percent of the value of the land for the development permission granted in each phase of the development proposed as a condominium (net of any exclusions or exemptions authorized under the Community Benefits Charge By-law), as determined the day before the day the first building permit is issued in respect of the development.

 

11. In the event that the affordable rental housing is provided, in accordance with the Official Plan Amendment, City Council authorize the Executive Director, Development Review to enter into an Agreement pursuant to subsection 37(7.1) of the Planning Act (the "In-kind Contribution Agreement") to address the provision of the In-kind Contribution on terms satisfactory to the Executive Director, Development Review in consultation with the Chief Planner and Executive Director, City Planning and Executive Director, Housing Secretariat, and in a form satisfactory to the City Solicitor.

 

12. City Council determine that the execution and registration of the In-kind Contribution Agreement constitute satisfactory arrangements for the provision of the In-Kind Contribution for the condominium development for the purpose of Applicable Law as defined in the Building Code.

The proposal comprises four new mixed-use buildings with six towers ranging in heights between 18 and 35 storeys containing 1,947 dwelling units. The development also includes the retention of an existing medical office building and the provision of affordable housing, new non-residential gross floor area, and a new public park and new public street.

 

A Draft Plan of Subdivision application has been submitted to establish the necessary development blocks including an existing employment block, a park block, and a new public street and to implement the proposed phasing plan. The draft plan of subdivision will be brought forward to City Council at a later date.

 

The proposed development is consistent with the Provincial Planning Statement (2024) and conforms to the City’s Official Plan. It advances key city-building objectives by delivering a comprehensive redevelopment that integrates residential, commercial, and community-oriented uses within a coordinated site.

Summary

This report recommends approval of a City-initiated Official Plan Amendment to delineate the Mount Dennis Protected Major Transit Station Area (PMTSA) as Site and Area Specific Policy 671 (SASP 671) to be contained in Chapter 8 of the Official Plan. SASP 671 would establish the PMTSA policy framework for Mount Dennis Station, including the station area delineation, authorized uses of land, minimum densities for buildings and structures, and a planned minimum population and employment target of 160 residents and jobs combined per hectare.

 

Mount Dennis Station is a major transit interchange served by TTC Line 5 Eglinton Light Rail Transit, GO Transit Kitchener Line and UP Express near Eglinton Avenue West and Weston Road. The proposed PMTSA implements provincial requirements to delineate major transit station areas and advances the City's Official Plan goal of creating sustainable complete communities which include transit-supportive growth, affordable housing, employment opportunities, and other local amenities.

 

The recommended Official Plan Amendment is consistent with the Provincial Planning Statement (2024), conforms to the Greenbelt Plan (2017), has regard to matters of provincial interest under Section 2 of the Planning Act and conforms to the Official Plan and the Mount Dennis Secondary Plan. The amendment will be submitted to the Minister of Municipal Affairs and Housing for approval pursuant to Section 26 of the Planning Act. There is no appeal of the Minister's decision on this OPA.

2. provide a Heritage Lighting Plan that describes how the exterior of the heritage property will be sensitively illuminated to enhance its heritage character to the satisfaction of the Senior Manager, Heritage Planning and thereafter shall implement such a plan to the satisfaction of the Senior Manager, Heritage Planning.

 

3. submit a Signage Plan to the satisfaction of the Senior Manager, Heritage Planning.

 

4. provide a detailed Landscape Plan for the subject property, satisfactory to the Senior Manager, Heritage Planning.

 

5. Provide building permit drawings, including notes and specifications for the conservation and protective measures keyed to the approved Relocation and Conservation Plan required in Recommendation 2.b., including a description of materials and finishes, to be prepared by the project architect and a qualified heritage consultant to the satisfaction of the Senior Manager, Heritage Planning.

 

6. Provide a Letter of Credit, including provision for upwards indexing, in a form and amount and from a bank satisfactory to the Senior Manager, Heritage Planning, to secure all work included in the approved Relocation and Conservation Plan and Interpretation Plan.

 

e. prior to the release of the Letter of Credit required in Recommendation 2.d.6. above, the owner shall:

(June 15, 2026) Report from the Senior Manager, Heritage Planning, Urban Design, City Planning

Summary

This report recommends that City Council approve alterations to and removal of a heritage attribute of the heritage property at 1151 Weston Road, with conditions under Sections 33 and 34(1) 1 of the Ontario Heritage Act. This is in connection with an Official Plan Amendment and Zoning By-law Amendment application seeking approval for the construction of a 46-storey mixed use building on the subject property. This report also seeks Council authority to enter into a Heritage Easement Agreement.

 

The subject property, which contains a Part IV designated Scotiabank branch building, is located on the north-east corner of Weston Road and Eglinton Avenue. Built in 1949, the bank building originally abutted the Weston Road property line; however, to facilitate a road realignment in 1965, the building was moved back on the lot thereby creating an expansive front lawn condition that did not exist when the bank first opened.

 

The one-storey building was designed by Gordon S. Adamson in the modernist style to emphasize "openness and accessibility" (Designation Report, 2025). Heritage attributes of the property include ashlar-faced limestone-cladding, symmetrical north elevation, asymmetrical west (principal) elevation which has three bas relief panels, and a double entrance with a vestibule and projecting roof. The location of the building at the northeast corner of Weston Road and Eglinton Avenue West and its orientation towards Weston Road are also heritage attributes. In 1981-82 a modern side addition was constructed.

This report recommends that City Council approve alterations to and removal of a heritage attribute of the heritage property at 1151 Weston Road, with conditions under Sections 33 and 34(1) 1 of the Ontario Heritage Act. This is in connection with an Official Plan Amendment and Zoning By-law Amendment application seeking approval for the construction of a 46-storey mixed use building on the subject property. This report also seeks Council authority to enter into a Heritage Easement Agreement.

 

The subject property, which contains a Part IV designated Scotiabank branch building, is located on the north-east corner of Weston Road and Eglinton Avenue. Built in 1949, the bank building originally abutted the Weston Road property line; however, to facilitate a road realignment in 1965, the building was moved back on the lot thereby creating an expansive front lawn condition that did not exist when the bank first opened.

 

The one-storey building was designed by Gordon S. Adamson in the modernist style to emphasize "openness and accessibility" (Designation Report, 2025). Heritage attributes of the property include ashlar-faced limestone-cladding, symmetrical north elevation, asymmetrical west (principal) elevation which has three bas relief panels, and a double entrance with a vestibule and projecting roof. The location of the building at the northeast corner of Weston Road and Eglinton Avenue West and its orientation towards Weston Road are also heritage attributes. In 1981-82 a modern side addition was constructed.

1. 2. Prior to the introduction of the Part Lot Control Exemption By-law, City Council require:

 

a. the Plan of Subdivision (22 221213 WET 05 SB) for the property at 175 to 185 Eileen Avenue be registered to the satisfaction of the City Solicitor;

 

b. the owner to provide proof of payment of all current property taxes for the subject lands to the satisfaction of the City Solicitor; and

 

c. the owner to register, to the satisfaction of the City Solicitor, a Section 118 Restriction under the Land Titles Act agreeing not to transfer or charge any part of the subject lands described in Schedule “A” to this Report, without prior written consent of the Executive Director, Development Review or their designate to the satisfaction of the City Solicitor.

 

3. City Council authorize the City Solicitor to take the necessary steps to release the Section 118 Restriction from all or any portion of the lands in the City Solicitor's sole discretion after consulting with the Executive Director, Development Review at such time as confirmation is received that a plan of condominium has been registered or upon expiry or repeal of the Part Lot Control Exemption By-law.

 

4. City Council authorize and direct the City Solicitor to register the Part Lot Control Exemption By-law on title following enactment.

 

5. City Council authorize the City Solicitor to repeal or amend the Part Lot Control Exemption By-law to delete part of the lands described in the bylaw, if the City Solicitor determines, in her sole discretion after consulting with the Executive Director, Development Review, that it is necessary prior to releasing or partially releasing the Section 118 Restriction from title.

 

6. City Council authorize the City Solicitor to make such stylistic and technical changes to the draft Part Lot Control Exemption By-law as may be required.

Summary

This report provides an update on the Ryding Lands Study ("the Study"), including recommended Emerging Directions. The Ryding Lands are located south of St Clair Avenue West, between Runnymede Road and Keele Street (see Location Map in Attachment 1). The Emerging Directions are intended to inform the review of development applications and to guide future policy development as the Study progresses. They articulate the intent for the Ryding Lands, including transformative change from low-scale industrial uses to a more intensely developed area with a diverse mix of land uses supported by new streets, services and public spaces.

 

The Emerging Directions are discussed under the following themes:

 

- Expand the Study Boundary to the West;

- Ensure a Range of Non-Residential Uses to Support Mixed Use Development;

- Enhance the Public Realm;

- Encourage Opportunities for a Consolidated Park;

- Build a Connected Mobility Network for all Users;

- Identify Community Infrastructure to Support Growth;

- Prioritize Green Infrastructure in Development;

- Ensure Built Form Responds to the Surrounding Context;

- Support Links to Local Heritage;

- Ensure the Provision of a Range of Housing Options; and

- Support Coordinated Implementation.

 

The Study was initiated in the summer of 2025 by a multi-disciplinary staff team, supported by consultants for select background studies. It was initiated as a result of Official Plan Amendment (OPA) 653, which redesignated the lands from Core Employment Areas to Mixed Use Areas and put in place Site and Area Specific Policy (SASP) 832.

 

To date there have been two public meetings, as well as meetings with property owners. Outreach to First Nations and urban Indigenous organizations occurred in a coordinated manner with the City's eight active Regeneration Area Studies. Regarding the Ryding Lands Study, the Mississaugas of the Credit First Nation asked to be kept informed.

 

Input from staff, divisional partners and agencies, consultants, and engagement activities has informed the drafting and refinement of the Emerging Directions. Next steps for the Study include completing the background studies and developing draft policies in accordance with the Emerging Directions included in this report.

 

Staff anticipate bringing forward the recommended policies through an Official Plan Amendment in Q1 2027.

Chair Holyday recognized a number of guests in the Council Chamber who were there to honour Constable John Zivcic:

 

- Chief Frank Bergen from Hamilton Police, the former Toronto Police Service 22 Division Unit Commander;

- Superintendent Justin Vanderhaden, current Toronto Police Service 22 Division Unit Commander;  

- Staff Sergeant Christina Donaldson; and 

- Toronto Police Constables Fred Hodgson, Andrew Blanc and Dan McGraff.

 

Chair Holyday advised that the naming of the park as Constable John Zivcic Park, was an important part of Toronto’s history, and an important acknowledgement of community service in recognition of Constable John Zivcic who died in the line of duty on December 2, 2013, while serving as a traffic enforcement officer in 22 Division in Etobicoke.

 

Councillor Morley thanked all those involved in spearheading the naming of the park and expressed her support.  The naming recognizes Constable Zivcic’s service, his sacrifice and his connection to the Etobicoke community.

Summary

City Council adopted the Commemorative Framework at its July 2022 meeting. The Framework provides guidance to the public, Elected Officials, and City staff regarding the commemorative naming and renaming of streets and City properties, and the consideration of proposals for new and existing commemorative monuments.

 

The proposal seeks to name a new park at 3780 Bloor Street West as “Constable John Zivcic Park.” The proposal has received strong support from colleagues in Toronto Police Service 22 Division and a local community organization, recognizing Constable John Zivcic’s (1979–2013) dedication to public safety and community service.

 

Parks and Recreation, in collaboration with the Economic Development and Culture Division and Strategic Partnerships, reviewed the application. The review concluded that the naming proposal satisfies the criteria of the Property Naming Policy and aligns with the Guiding Principles for Commemoration.

The applicant is seeking permission to maintain an existing wood fence located along the rear perimeter lot line of the property. The fence exceeds the maximum permitted height of 2.0 metres and measures between approximately 2.25 metres and 2.97 metres in height when calculated using average grade in accordance with Chapter 447.

 

The property is a residential lot containing an existing wood privacy fence situated along the rear lot line and portions of the side lot lines. Due to significant grade differences between 5 Alderton Court and the abutting properties, fence heights vary substantially when measured from either side of the fence. While the fence generally measures approximately 2.0 metres to 2.5 metres in height from the applicant's side of the property, the lower grades on adjacent properties result in greater fence heights and average-grade measurements that exceed the maximum permitted height under Chapter 447.

 

Municipal Licensing and Standards staff conducted site inspections and obtained measurements at various locations along the fence. Measurements were recorded from both sides of the fence and average-grade calculations were completed in accordance with the requirements of Toronto Municipal Code, Chapter 447 – Fences.

 

There is a grade differential between the subject property and the adjacent properties.

The purpose of this report is to advise Community Council regarding the application submitted by the property owner of 25 Franson Crescent seeking approval for an existing wood fence that exceeds the maximum permitted height requirements. Municipal Licensing and Standards staff conducted a site inspection and obtained measurements of the existing fence panels from roadway inward. The measurements confirm that all existing fence panels located along the front driveway exceed the maximum permitted height prescribed by Chapter 447 – Fences.

 

Panel 1: The wood fence panel measures 1.6 metres in height, exceeding the permitted by-law height of 1.2 metres by 0.4 metres. Including the post and cap, the total height is 1.8 metres, exceeding the permitted height by 0.6 metres. This report responds to an application submitted by the owner of 3100 Weston Road requesting a site-specific Fence Exemption under Toronto Municipal Code, Chapter 447, Sections 447-1.2A(2) and 447-1.2B(1) – Fences.

 

The owner is seeking approval to maintain an existing aluminum fence approximately 3.0 metres in height with barbed wire installed along the top, located along portions of the north and west sides of the property. The application also proposes the construction of additional fence sections along the south side of the property to match the existing fence.

 

Municipal Licensing and Standards staff determined that the existing and proposed fencing exceeds the maximum permitted height permitted under Chapter 447 and includes barbed wire, a prohibited fence component. As a result, a Notice of Violation was issued, and the owner subsequently submitted a Fence Exemption application.

 

Given that the fence does not comply with the height and construction requirements of Toronto Municipal Code, Chapter 447 – Fences, staff are of the opinion that the requested exemption is not supportable.

This report recommends that City Council authorize a correction to the by-law respecting the permanent closure of portions of Dundas Street West, Kipling Avenue and Bloor Street West in the Six Points area.

 

City Council previously adopted Etobicoke York Community Council item EY24.19 at its meeting of June 8 and 9, 2021, authorizing the permanent closure of portions of Dundas Street West, Kipling Avenue and Bloor Street West. By-law 503-2021 was subsequently enacted; however, the by-law was not registered on title. Following further review, it was determined that the legal descriptions contained in the enacted by-law require a revision before registration can proceed.

 

In particular, Part 4 on Plan 66R-31942 was included in the prior by-law description in error and is not included in the revised legal descriptions recommended through this report. The corrective by-law recommended through this report is intended to accurately describe only those lands to be permanently closed as a public highway. The revised closure lands are Part 2 on Plan 66R-31342 and Parts 2 and 3 on Plan 66R-31942 for Dundas Street West, Part 5 on Plan 66R-31942 for Kipling Avenue; and Part 1 on Plan 66R-31942 for Bloor Street West.

 

This report does not alter the underlying policy intent or redevelopment purpose previously approved by Council. The purpose of this report is to ensure that the legal descriptions associated with the permanent highway closure accurately reflect the intended closure limits and can proceed to registration.

Community Council Decision

The Etobicoke York Community Council:

 

1. Authorized the General Manager of Transportation Services to enter into an encroachment agreement with the owner of 70 Lacey Avenue to permit the construction and maintenance of a reinforced concrete retaining wall varying from approximately 1.8 metres to 2.8 metres in height, with a footing varying from approximately 1.2 metres to 1.9 metres in depth and located with zero setback from the sidewalk, subject but not limited to, the following conditions:

 

a. The property owner will indemnify the City of Toronto from and against all actions, suits, claims or demands and from all loss, costs, damages, and expenses that may result from such permission granted;

 

b. The property owner will maintain the encroachment at their own expense in good repair and a condition satisfactory to the General Manager of Transportation Services and will not make any additions or modifications to the encroachment beyond what is allowed under the terms of the Agreement;

 

c. The property owner will accept such additional or amended conditions as the City Solicitor, or the General Manager of Transportation Services may deem necessary in the interest of the City;

 

d. The property owner will remove the encroachment upon receiving written notice from Transportation Services to do so;

 

e. The property owner will enter into an encroachment agreement with the City of Toronto, at the applicant's expense, and assume all liability and damages related to the encroachment;

 

f. Transportation Services and/or utility companies may remove the encroachment at any time to install or maintain their assets within the affected public right of way with no obligation to reinstate them;

 

g. No spikes or pointed tops are permitted on the encroachment;

 

h. The encroachment agreement shall not permit or authorize any drainage works, including the installation of drainage pipes, weeping tiles, connections, conduits, or any other system designed to collect or direct water, other than the weeping tiles located below the soft landscaping identified on the approved encroachment plans. The property owner shall not connect, discharge, or permit the discharge of any water, runoff, or other effluent from the property or the encroachment to the City's stormwater or sanitary infrastructure, or onto any other portion of the public right-of-way. Notwithstanding the foregoing, to the extent that any weeping tiles or subsurface drainage elements form part of the encroachment beneath the soft landscaping, the property owner shall be solely responsible for ensuring the proper drainage, functioning, and ongoing performance of the encroachment, including all subsurface elements, and shall ensure that such drainage systems do not cause, contribute to, or allow erosion, undermining, settlement, or any other damage to the public right-of-way or other City infrastructure, and shall take all necessary measures to prevent adverse impacts to the public right-of-way, including adjacent sidewalks, boulevards, and subsurface utilities;

 

i. The encroachment shall be constructed, installed, occupied, and maintained in a manner that ensures it does not:

 

1. create, cause, or allow any water, effluent, sediment, mud, debris, runoff, or other discharge or material to drain or deposit onto, accumulate on, or flow across the sidewalk, boulevard, roadway, or any portion of the public right-of-way, including in a manner that could result in pooling, icing, or any actual or potential nuisance or hazard; and

 

2. extend beyond the limits identified in the approved encroachment plans, including but not limited to any heights, depths, or lateral limits identified in such plans;

 

j. The property owner shall release, waive, and forever discharge the City of Toronto and its employees, officers, agents, and representatives from any and all claims for loss, damage, or injury, including property damage, personal injury, bodily injury, or death, arising out of or related to:

 

1. the City's inspection, maintenance, repair, clearing, salting, sanding, plowing, or other winter or non-winter maintenance activities performed within the public right-of-way, including the sidewalk adjacent to the encroachment, including any incidental impacts to the encroachment or the property; and

 

2. any nuisance, hazardous condition, or other situation created, caused, or contributed to by the encroachment, including, without limitation, any drainage, runoff, icing, slipperiness, obstruction, or other condition of the public right-of-way, including the sidewalk adjacent to the encroachment, attributable to the encroachment.

This staff report is about a matter for which Community Council has delegated authority from City Council to make a final decision.

 

The purpose of this report is for Etobicoke York Community Council to consider an appeal from the property owner of 70 Lacey Avenue regarding their encroachment application. The proposed encroachment consists of a reinforced concrete retaining wall that does not comply with City of Toronto Municipal Code Chapter 743, Streets and Sidewalks, Use of.

 

The property owner is seeking authorization from Etobicoke York Community Council to allow the construction and maintenance of the encroachment within the public right-of-way at 70 Lacey Avenue. Summary

In 2021, residents of Ryding Avenue submitted a petition requesting the installation of a traffic island on the north side of the street, east of Cobalt Avenue, to deter westbound cut-through traffic between Keele Street and Jane Street.

 

On March 6, 2024, during a community consultation for the proposed development at 87 Ethel Avenue, residents raised ongoing concerns regarding traffic volumes on Ryding Avenue and the anticipated increase in vehicular activity, particularly with respect to pedestrian and neighbourhood safety. In response, a petition was submitted requesting the conversion of Ryding Avenue to a one-way eastbound street.

 

On April 30, 2025, a motion was adopted to implement the one-way eastbound conversion. With this measure now in place and effectively reducing through traffic, the existing traffic island is no longer required and may be removed.

My office recently received a petition with over 90 signatures from Mimico residents requesting a pedestrian crossing at the intersection of Hillside Ave and Royal York Road to better support access to John English Junior Middle School and Mimico Memorial Park.

In 2024, Transportation Services reviewed this request, however the intersection did not meet the City's technical criteria for installing a protected pedestrian crossing. Given continued community interest and changes in the area over the past couple of years, I recommend that Transportation Services conduct a new review of the intersection and report back on the feasibility of installing a crossing at this location.

Residents have expressed concerns about unsafe road conditions on Manitoba Street, between Grand Avenue and Legion Road, caused by both speeding vehicles coming off the Gardiner Expressway and sightline obstructions caused by vehicles parking along both sides of Manitoba Street. The parked vehicles create challenges for motorists exiting the westerly driveway and cause unsafe pedestrian crossing conditions. To mitigate the sightline concerns, I am recommending expanding the “no stopping” regulations around the westerly driveway. To improve pedestrian safety and slow down traffic, I am recommending the installation of speed cushions on Manitoba Street, between Grand Avenue and Legion Road.

Summary

My office has received a petition signed by representatives of 52 households, along with supporting documentation detailing a pattern of hazardous driving conditions. Residents are requesting urgent intervention to improve safety through the implementation of traffic calming measures, including speed humps, bollards, increased signage and signalization.

 

St. Phillips Road is a residential street with a significant number of families and young children. Documented incidents, including repeated speeding and loss-of-control collisions, indicate a persistent safety risk. Notably, two separate collisions occurred on December 14, 2025, May 24, 2026 in which vehicles struck the same hydro pole in front of 47 St. Phillips Road. These incidents, occurring within a six-month period, resulted in substantial damage and neighbourhood-wide power outages, underscoring the recurring nature of the issue. According to TPS, a total of 35 Motor Vehicle Collision events have occurred since 2024 on St. Phillips Road.


In addition to the immediate risk to public safety, these incidents impose financial costs related to emergency response, infrastructure repair, and service restoration.


Given the documented pattern of incidents and strong community support, a formal traffic safety review is warranted. Subject to Transportation Services’ assessment, the implementation of traffic calming measures such as speed humps should be considered to mitigate risk and improve safety along St. Phillips Road. Should any remedial traffic safety measures be available through staff delegated authority, staff be directed to implement such measures as soon as practicable, recognizing the significant safety concerns identified by residents and the urgency of addressing these issues pending completion of any further review or approval processes.

Announcements

 

The Chair acknowledged that the Etobicoke York Community Council was meeting on the traditional territory of many nations including the Mississaugas of the Credit, the Anishnabeg, the Chippewa, the Haudenosaunee and the Wendat peoples and is now home to many diverse First Nations, Inuit and Métis peoples. The Chair also acknowledged that Toronto is covered by Treaty 13 with the Mississaugas of the Credit.

 

The Chair thanked all those that helped make the 2022-2026 series of Etobicoke York Community Council meetings a success, including the citizens who come to depute and send letters, his colleagues on the Community Council and the Toronto Public Service staff.

 

The Chair recognized Elisabeth Silva Stewart, the Manager, Community Planning, Development and Growth Services, for all her contributions to the Etobicoke York Community Council, and wished her the best in retirement.

 

Where the Members of the Etobicoke York Community Council listed in the attendance for this meeting participated remotely, they were counted for quorum as permitted by Section 189(4.2) of the City of Toronto Act, 2006, and City Council's Procedures.
