The purpose of this report is to advise Community Council concerning an application by the property owner of 499 Briar Hill Avenue for a site-specific Fence Exemption, pursuant to Section 447-1.5(B) of Toronto Municipal Code, Chapter 447 - Fences. The property owner is seeking Community Council’s permission to maintain the follow:
1. A gate on the second story deck in the rear of the property that will not comply with the standards stipulated by Section 447-1.3(D)(1). This gate is made from tempered glass and measured at 1.06 metres in height.
2. An enclosure from the walkout basement that will not comply with the standards stipulated by section 447-1.3 (E) (1) (b). This enclosure is not located more than one metre away to any external condition that may facilitate climbing.
A Notice of Violation was issued to the property owners on December 6, 2024. The property owner has implemented alternative safety measures, including an enclosure constructed from marine-grade mesh vinyl material. This enclosure, measuring 1.2 metres in height, surrounds the east and south sides of the pool. Additionally, a pool cover, made from heavy-duty vinyl composite, has been installed, covering an area of 26.7 square meters. However, both measures do not comply with the requirements outlined in the Toronto Municipal Code, Chapter 447 - Fences.

The purpose of this report is to inform Community Council of an application submitted by the property owner of 499 Briar Hill Avenue requesting a site-specific Fence Exemption under Section 447-1.5(B) of the Toronto Municipal Code, Chapter 447 – Fences. The application was initially considered on April 2, 2025, under Item NY22.6 at which time the decision was made to defer the matter to April 30, 2025 under item NY23.3, meeting of the North York Community Council. The item was further deferred to June 4,2025 under item NY24.1 and then to September 17, 2025.
Subsequently, the property owners advised they are willing to comply with the Order and forego the fence exemption.

North York Community Council recommends that:

This Report recommends approval of the application to amend the Zoning By-law with a holding provision that will have the effect of permitting six two-storey detached dwellings with a total residential gross floor area of 2,192 square metres when six lots fronting a new private street are created through a future common elements condominium application. A total of 12 residential parking spaces will be provided. The proposal will also identify lands to be zoned as Open Space at the rear of the subject site with an area of 2,750 square metres.
A related plan of subdivision application (File 20 234714 NNY 17 SB) is also with the City for approval. The authority to approve the plan of subdivision is delegated to the Executive Director, Development Review or their delegate, the Director of Community Planning. The plan of subdivision will have the effect of creating two blocks- one for the future residential units including a 10 metre buffer and a second for the open space block.
The proposed Zoning amendment application is consistent with the Provincial Planning Statement (2024) and conforms to the City's Official Plan. The draft plan of subdivision has regard for the criteria in Section 51(24) of the Planning Act, subject to addressing outstanding technical matters from the ongoing technical review of the application. The Draft Plan of Subdivision creates necessary blocks to support the implementation of the Zoning By-law Amendment application.
This report advises that the Executive Director of Development Review or their delegate, the Director of Community Planning, North York intends to approve the draft plan of subdivision subject to the conditions as set out in this report, after outstanding matters arising from the technical review of the application as outlined in this report have been addressed. Any comments that are received by the public at North York Community Council will be considered as part of the decision on the plan of subdivision.

The project will be completed in two phases, each involving varying closures on Sheppard Avenue West and Cocksfield Avenue. This report pertains to Phase 1 of the project and seeks Council authorization for the temporary closure of the south sidewalk and a portion of the westbound curb lane on Cocksfield Avenue, in order to accommodate below-grade construction activities. The closures are required for a period of 10 months, from October 31, 2025 to August 31, 2026.
It should be noted that there is currently no sidewalk on the north side of Cocksfield Avenue, and the south side lacks a sidewalk east of the proposed construction staging area. At the present, the only available sidewalk is located on the south side of Cocksfield Avenue, stretching from Wilmington Avenue and terminating at the eastern boundary of the proposed construction staging area. Notwithstanding, advanced warning signage will be installed east and west of the closure to inform pedestrians to cross to the opposite side of the roadway.

11. Directed the applicant to provide and install public art, including mural artwork, onto every elevation of the hoarding board with adequate spotlighting for night-time illumination, at their sole cost, to the satisfaction of the Ward Councillor.

From the intersection of Three Valleys and Laurentide Drive to Kestell Lane, the speed limit is 40 kilometre per hour. While the remaining stretch to the end of Three Valleys is 50 kilometre per hour.
Residents living on the road contacted my office about the inconsistency, and requested that we make the speed limit consistent, therefore making all of Three Valleys Drive 40 kilometre per hour. Reasons for implementing this change include:

The area south-west of York Mills Road and Bayview Avenue, particularly on Highland Crescent, is experiencing persistent traffic issues that include speeding, running stop signs and growing volumes of infiltration traffic. In addition to other initiatives my office is working on in collaboration with the Transportation Services division, a serious concern we have heard from many residents is the safety of the Highland Crescent and Beechwood Avenue intersection.
Currently a two-way stop for eastbound and westbound traffic, residents and drivers have reported that the intersection is highly problematic with east / westbound drivers routinely not stopping, while north / southbound drivers either race through the intersection, or indeed slow down because they are confused why it is not an all-way stop already.
In the past few years, there have been several collisions. We are aware that the last time the warrant criteria were checked, the Potentially Preventable Collision count did not fully reach 6 over 2 years. However, there is wholly credible information that the reported number of collisions undercounts the real number of accidents due to non-reporting.
We further note that the warrant counts for Vehicle / Pedestrian Volume as well as Percentage of Traffic on Major Street were very close on the last study day of March 19, 2025 (a day that happened to fall in the March Break period for private schools, some of whose parents are known to use Highland Crescent for the school commute).
To address the real safety concerns at this intersection, I am therefore seeking to install all-way compulsory stop control at Highland Crescent and Beechwood Avenue.
