1.  The Infrastructure and Environment Committee, in accordance with Section 195-8.4A of the Toronto Municipal Code Chapter 195 (Purchasing), grant authority to award Contract Number 19ECS-MI-01NT, Request for Tenders Document Number 2541506237, for Process and Electrical Condition Assessment Project Upgrades at North Toronto Treatment Plant, in the amount of $30,842,400 net of all applicable taxes and charges ($31,385,226 net of Harmonized Sales Tax recoveries) to Bennett Mechanical Installations (2001) Limited, having submitted the lowest compliant bid and meeting the specifications in conformance with the Tender requirements.

 

2.  The Infrastructure and Environment Committee, in accordance with Section

C of the City of Toronto Municipal Code Chapter 71 (Financial Control), grant authority to amend the Purchase Order Number 6051147 with CIMA Canada Incorporated for providing Professional Services during Construction in the amount of $984,557 net of all applicable taxes and charges ($1,001,885 net of Harmonized Sales Tax recoveries), revising the current Purchase Order value from $1,394,391 net of all applicable taxes and charges ($1,418,933 net of Harmonized Sales Tax recoveries) to $2,378,949 net of all applicable taxes and charges ($2,420,818 net of Harmonized Sales Tax recoveries).

Summary

The purpose of this report is to:

 

1.  Advise of the results of Request for Tender Document Number 2541506237, Contract Number 19ECS-MI-01NT, for Process and Electrical Condition Assessment Project Upgrades at North Toronto Treatment Plant and request authority to award the contract to Bennett Mechanical Installations (2001) Limited, in the amount of $30,842,400 net of all applicable taxes and charges ($31,385,226 net of Harmonized Sales Tax recoveries); and,

1.  The Infrastructure and Environment Committee, in accordance with Section 195-8.4A of the Toronto Municipal Code Chapter 195 (Purchasing), grant authority to award Request for Proposal Number Doc2248482116 to CH2M Hill Canada Limited having submitted the highest scoring proposal meeting the requirements of the Request for Proposal to provide Professional Services for Design, Contract Administration and Post Construction Services for the Secondary Treatment System Upgrades at the Ashbridges Bay Treatment Plant in the amount of $42,590,930 net of all applicable taxes ($43,340,532 net of Harmonized Sales Tax recoveries), including disbursements, provisional allowances and contingencies, where the agreements are established by major task categories as follows:

 

a. For the Preliminary Design and Detailed Design services of the Secondary Treatment System Upgrades in the amount of $16,726,848 net of Harmonized Sales Tax, including labour, disbursements, provisional allowances and contingencies. This amount includes a provisional allowance of $3,360,000 and a contingency allowance of $2,800,000 net of Harmonized Sales Tax, for additional services, if necessary and authorized by the Chief Engineer and Executive Director, Engineering and Construction Services.

 

b. For Construction Administration services during the first construction Contract "Blower #9 replacement in East Blower building" in the amount of $680,503 net Harmonized Sales Tax, including labour, disbursements, provisional allowances and contingencies. This amount includes a provisional allowance of $50,000 and a contingency allowance of $115,000 net of Harmonized Sales Tax, for additional services, if necessary and authorized by the Chief Engineer and Executive Director, Engineering and Construction Services.

 

c. For Construction Administration services during the main construction Contract in the amount of $24,220,355 net Harmonized Sales Tax, including labour, disbursements, provisional allowances and contingencies. This amount includes a provisional allowance of $ 3,100,100 and a contingency allowance of $4,000,000 net of Harmonized Sales Tax, for additional services, if necessary and authorized by the Chief Engineer and Executive Director, Engineering and Construction Services.

 

d. For Post Construction services, upon achievement of substantial performance of the first construction Contract "Blower #9 replacement in East Blower building" in the amount of $126,494 net Harmonized Sales Tax, including labour, disbursements, provisional allowances and contingencies. This amount includes a provisional allowance of $15,000 and a contingency allowance of $20,000 net of Harmonized Sales Tax, for additional services, if necessary and authorized by the Chief Engineer and Executive Director, Engineering and Construction Services.

 

e. For Post Construction services, upon achievement of substantial performance of the main construction Contract in the amount of $836,730 net Harmonized Sales Tax, including labour, disbursements, provisional allowances and contingencies. This amount includes a provisional allowance of $ 330,000 and a contingency allowance of $140,000 net of Harmonized Sales Tax, for additional services, if necessary and authorized by the Chief Engineer and Executive Director, Engineering and Construction Services.

 

For each of a, b, c, d and e, all agreements are to be in accordance with the terms and conditions as set out in the Request for Proposal and any other terms and conditions satisfactory to the Chief Engineer and Executive Director, Engineering and Construction Services, in a form satisfactory to the City Solicitor, and the services and dollar amounts set out to be executed as five (5) distinct consulting agreements and the issuance of five (5) Purchase Orders.

The purpose of this report is to advise of the results of Request for Proposal Number Doc2248482116 (9117-20-7023) for the Provision of Professional Services for Design, Contract Administration and Post Construction Services for the Secondary Treatment System Upgrades at the Ashbridges Bay Treatment Plant and to request award of the Request for Proposal to CH2M Hill Canada Limited in the amount of $42,590,930 net of all applicable taxes and charges, $43,340,532 net of Harmonized Sales Tax recoveries.

Financial Impact

The total value of the contract award for Document Number Doc2248482116 for the Provision of Professional Services for Design, Contract Administration and Post Construction Services for the Secondary Treatment System Upgrades at the Ashbridges Bay Treatment Plant is $48,127,751 including Harmonized Sales Tax and all applicable charges. This includes a total contingency amount of $7,994,750 including Harmonized Sales Tax and a total provisional sum amount of $7,746,263 including Harmonized Sales Tax. The total cost to the City for the project is $43,340,532 net of Harmonized Sales Tax recoveries including $7,199,520 in contingency amounts and $6,975,749 in provisional sums.

Financial Impact

The total value of the contract award for Contract Number 20ECS-MI-01TW, Request for Tender Number Doc2611519655, for Zebra Mussel Control System and Lake Current Monitoring Upgrades at the R.L. Clark and F.J Horgan Water Treatment Plant is $26,283,008 including Harmonized Sales Tax and all applicable taxes. The cost to the City is $23,668,663 net of Harmonized Sales Tax recoveries. The awarded amount includes a contingency allowance of $2,250,000 on the base scope of work to cover contingencies and/or additional work or services under the construction contract to address any unforeseen conditions which may arise during construction and is consistent with City practice.

 

Funding is included in the proposed 2021-2030 Capital Budget and Plan for Toronto Water. Funding details are provided in Table 1.

Summary

The purpose of this report is to request authority to award a non-competitive bridge contract to Parsons Inc. for the provision of RESCU Transportation Operations Centre Operations services in the amount of $834,430.48 net of Harmonized Sales Tax ($849,116.46 net of Harmonized Sales Tax recoveries), for the period March 1, 2021 to September 30, 2021 under the same contract terms and conditions set out in Request for Proposal Number 9117-16-7060.

This contract provides 24/7 operations for dispatching emergency transportation maintenance calls (i.e. electronic traffic control devices, traffic signs, right-of-way issues), providing traffic incident management on the City's roadways and traveller information to the public.

 

This non-competitive bridge contract will provide the essential traffic management services until a new competitive contract can tendered and awarded. Further, this extension will provide enough time for the new contractor to hire, train and transition themselves to take over the operation of the RESCU Transportation Operations Centre on October 1, 2021.

 

City Council approval is required in accordance with Municipal Code Chapter 195, Purchasing, where the current request exceeds the Chief Purchasing Officer's authority of the cumulative five year commitment limit for each vendor under Article 7, Section 195-7.3(D) of the Purchasing By-law or exceeds the threshold of $500,000 net of Harmonized Sales Tax allowed under staff authority as per the Toronto Municipal Code, Chapter 71, Financial Control, Section 71-11a.

Financial Impact

The total value of this procurement is $834,430.48 net of Harmonized Sales Tax, and the total cost to the City for this procurement is $849,116.46 net of Harmonized Sales Tax recoveries.  This funding has been included in the 2021 Operating Budget Submission for Transportation Services under the Cost Center TS7010.

The General Manager, Parks, Forestry and Recreation, recommends that:  

 

1.  City Council authorize the General Manager, Parks, Forestry and Recreation to execute an amending and renewal agreement with Toronto Botanical Garden to extend the original 20-year term of the 2004 Management Agreement for another twenty years, to November 30, 2044, with an option to renew, at the General Manager's sole discretion after consultation with the Toronto Botanical Garden for an additional ten years after that, to November 30, 2054, all on terms and conditions satisfactory to the General Manager, and in a form satisfactory to the City Solicitor.

Summary

The purpose of this report is to seek authority from City Council to amend the 2004 Management Agreement with Toronto Botanical Garden, a registered charity, by extending its term for a second twenty year period, from December 1, 2024 to November 30, 2044, with an option to renew for an additional ten years after that, to November 30, 2054.

 

Under the Management Agreement with the City of Toronto, Toronto Botanical Garden manages 1.6 hectares of space, including indoor facilities and gardens collectively called the Toronto Botanical Garden, on behalf of the City at the approximately 14 hectare site of Edwards Gardens.

 

At its April 24, 25, 26, and 27, 2018, meeting, City Council passed PE26.2, Growing the Gardens, to facilitate the implementation of the Edwards Gardens and Toronto Botanical Garden Master Plan and Management Plan. Those plans outline long-term improvements for Edwards Gardens - Toronto Botanical Garden to create a world-class horticultural facility and cultural attraction in an ecologically and fiscally sustainable way. The Master Plan and Management Plan calls for Toronto Botanical Garden to raise approximately $50 million in private and public funds for capital improvements to Edwards Gardens - Toronto Botanical Garden over multiple years.

 

To secure donor confidence in its fundraising plan to facilitate significant gifts, Toronto Botanical Garden has requested that the current Management Agreement be extended for an additional twenty years starting in 2024, with an option to renew for an additional ten years after that. Section 3 of the 2004 Management Agreement requires City Council approval in order to extend the term.

Financial Impact

There is no immediate financial impacts resulting from the adoption of the recommendation in this report.

 

Under the 2004 Management Agreement, Parks, Forestry and Recreation provides the Toronto Botanical Garden with $25,000 annually for custodial costs. Funding for these custodial costs will continue to be included in the Operating Budget submission for Parks, Forestry and Recreation through the annual budget process in future years.

Summary

Following more than ten years of planning, consultation, engineering design, and construction, the Six Points Interchange Reconfiguration Project in the Bloor Street West, Dundas Street West and Kipling Avenue area of Etobicoke is nearing completion.

 

The reconfiguration supports the development of Etobicoke Centre as a vibrant mixed-use transit-oriented community and the design features including:

 

- a new road network and at-grade intersection at Dundas Street, Bloor Street and Kipling Avenue;
- Complete Streets, with improved pedestrian facilities, wide boulevards, trees, street furniture, improved access to Kipling Subway Station, cycling infrastructure installed on all major streets;
- new land available for potential uses such as parkettes, public art installations, development and other amenities; and
- a district energy plan.
 

Reconstruction of the Six Points Interchange follows an Environmental Assessment completed in 2008, and detailed technical design study completed in 2016. The reconstruction removes existing bridges constructed in 1961, and creates regular intersections between Kipling Avenue, Bloor Street West and Dundas Street West.

 

This report seeks Council authorization of the traffic regulation amendments required to reflect current field conditions, including the authorization of traffic control signals, turn lane, bicycle lane and cycle track designations, and right-turn-on-red prohibitions. The proposed traffic regulation amendments were part of the approved design for the Six Points Interchange Reconfiguration Project.

Financial Impact

There is no financial impact with the adoption of this report. The existing traffic control signals, signage related to the proposed right-turn-on-red prohibitions, and signage and pavement markings related to the existing exclusive dual left/right-turn lanes, cycle tracks and bike lanes were included in the approved budget for the Six Points Interchange Reconfiguration Project (CTP811-35).

6. City Council direct the General Manager, Transportation Services, to work with Metrolinx to provide details of long-term road occupancy permits to the public on project websites, consistent with current practices deployed on the Eglinton Crosstown Light Rail Transit, Finch West Light Rail Transit and GO Expansion projects.

 

7. City Council direct that the traffic lanes and sidewalks be reopened when the projects are complete.

Summary

The purpose of this report is to seek approval to authorize the General Manager, Transportation Services until December 31, 2030 to temporarily close to pedestrian and vehicular traffic highways or portion of highways for a period up to and including 365 consecutive days, but ending no later than December 31, 2030, inclusive, as required for the purpose of construction of the Metrolinx Transit Expansion projects Ontario Line, Eglinton Crosstown West Extension and Yonge North Subway Extension.

 

This recommended delegation is similar to the authority previously granted to the General Manager, Transportation Services in relation to the Line 2 Scarborough Subway Extension, Line 5 Eglinton Crosstown Light Rail Transit, Line 6 Finch West Light Rail Transit and GO Expansion projects. This authority is necessary as the scope of the new Transit Expansion projects requires numerous concurrent and consecutive lane closures that will extend beyond thirty days during a multi-year construction period.

 

Delegation minimizes the chance of project delay and significantly reduces the administrative burden on City of Toronto staff, enabling them to focus on working with Metrolinx, contractors, local ward councillors, and the community to maximize the effectiveness of traffic management and construction scheduling.

Financial Impact

There is no financial impact to the City of Toronto associated with the recommendations in this report. Metrolinx's contractors are responsible for all costs required to implement all traffic management recommendations as conditions of permit approval.

2. City Council authorize the General Manager, Transportation Services to publish a Notice of Completion and file the Environmental Study Report for the yongeTOmorrow Schedule "C" Municipal Class Environmental Assessment on the public record for a minimum 30 days in accordance with the requirements of the Municipal Class Environmental Assessment Act.

Summary

Yonge Street is Toronto's most iconic street and it plays a symbolic role in the cultural identity of Toronto. The section between Queen Street and Carlton / College Street has a distinct character within the broader downtown context – it has a high concentration of pedestrians, street-related retail, and entertainment uses. This area attracts a large number of events, visitors, and tourists.

 

While the number of pedestrians on Yonge Street has somewhat lessened during the COVID-19 pandemic, in the last several years, Yonge Street has been struggling to serve the growing pedestrian demand which has resulted from more people living and working downtown. There is overcrowding and insufficient clearway on some sections of sidewalk. The number of pedestrians on the street is expected to continue to grow due to a projected doubling in population and employment in the surrounding area by 2041 along with a continued mode shift towards walking. Without improvement, the sidewalks will become critically deficient, risk pedestrian safety, and deter significant economic and cultural investment.

 

Yonge Street also lacks space for seating, sidewalk cafes, and plantings which support enjoyment of the street as a destination. With a limited right-of-way of 20 metres there are many demands being placed on the street by people walking, cycling, and driving. Prioritization and management of the interactions between all modes is critical. Consideration must also be given to the operation of surface transit, as well as curbside activities like deliveries and ride hailing which support the local economy.

 

The Downtown Plan (TOcore) adopted by City Council in May 2018 identified Yonge Street as one of Toronto’s Great Streets, a Cultural Corridor, and a Priority Retail Street. The goals set for Yonge Street in TOcore, along with consultation feedback, have guided the evaluation of alternatives for yongeTOmorrow and the prioritization of space within a physically limited public right-of-way.

 

yongeTOmorrow is a Municipal Class 'C' Environmental Assessment focused on the development and evaluation of design alternatives for Yonge Street from Queen Street to College / Carlton Street. A number of opportunities have been considered to increase pedestrian space and improve the way people move through and experience downtown Yonge Street.

 

This report summarizes the yongeTOmorrow Environmental Assessment process and the resulting Recommended Design Concept which proposes shifting the existing curb alignment to increase sidewalk widths by removing two driving lanes on Yonge Street from College / Carlton Street to Queen Street.

 

While the design of the street recommended through the yongeTOmorrow Environmental Assessment process would be consistent for the entire stretch, the study also evaluated various traffic operational strategies and proposes a flexible approach that would change the way the street functions from day to night. During the day, the one kilometre long stretch of Yonge Street between College / Carlton Street and Queen Street would be prioritized for people walking, cycling, and experiencing the street, while still providing for access and delivery routing needs through pedestrian priority zones, one-way and two-way driving access combined strategically to reduce traffic volumes. Overnight all blocks would have two-way driving access to support Toronto Transit Commission night bus service, deliveries, and general traffic.

 

A cast iron watermain constructed in 1889 exists beneath Yonge Street from Queen Street to College / Carlton Street. This watermain is due for replacement and Yonge Street will need to be reconstructed to facilitate replacement of the watermain. There is an urgency to arrive at a long term design solution for Yonge Street so that road works can be bundled with the watermain replacement.

Financial Impact

The estimated cost of future implementation of the recommended Design Concept is estimated at $70.5 million including detailed design, utility relocations, lighting, and watermain renewal. Construction would span three (3) years from approximately 2023 to 2025.  Funding of $10.7 million from Section 37 Planning Act Reserve Funds is already included in the approved Transportation Services 2020 – 2029 Capital Budget and Plan.  As per the stage gating process, as detailed design proceeds and there is more clarity on cost of implementation, the remaining funding for Transportation Services and Toronto Water will be requested for consideration through future budget processes, subject to overall funding priorities and coordination with other capital works.

Councillor Paula Fletcher recommends that:

 

1. The Infrastructure and Environment Committee request the General Manager of Parks, Forestry and Recreation, in collaboration with other divisions and agencies such the Toronto Regional Conservation Authority and Ports Toronto, to identify any potential new locations where storage for non-motorized crafts like canoes and kayaks and paddle boards could be accommodated and operationalized in the short-term, and to report back on their findings and recommendations at the March 23, 2021 meeting of Infrastructure and Environment Committee.

Summary

Many residents have contacted my office about the work currently being undertaken by Waterfront Toronto in partnership with Ports Toronto, Toronto and Region Conservation Authority and the City of Toronto to update the 2006 Marine Use Strategy. 

 

While they are broadly supportive of this long term initiative they are concerned about the lack of emphasis on the immediate need for storage and launch facilities for non-motorized crafts like canoes and kayaks and paddle boards.

 

During Covid, residents have used the lake in unprecedented numbers and many have called my office about getting facilities where they can leave their non-motorized crafts.

 

Growth of the recreational use of our waterfront is well documented and it is expected to continue to increase exponentially as the number of residents living and working near the water grows.  Existing facilities that provide storage have long waiting lists and are unable to accommodate any additional users.

 

I understand this type of storage is contemplated for areas such as Villiers Island however it will not be realized and functional for a number of years. The lack of storage for non-motorized craft is long-standing and it needs to be addressed in the short term.

 

Developing better connections to the lake, encouraging participation in healthy outdoor activity and enhancing access for residents from all ends of our city and all economic backgrounds is a goal we all share. Providing much needed storage for canoes, kayaks and paddle boards from various parts of the waterfront is one highly effective way of making that a reality for many Torontonians.
